Jokester Terms of Use

1. Welcome to Jokester

In short: We bring the comedy club to you — minus the overpriced drinks.

Jokester ("we," "our," or "us") is a U.S.-based pay-per-view and on-demand streaming platform for stand-up comedy. By using Jokester, creating an account, or buying a ticket, you agree to these Terms of Use ("Terms"). Please read them carefully — we've kept them as human as possible.

If you don't agree, please don't use Jokester. Otherwise, let's laugh together.

2. Eligibility

You must be 18 years or older and legally able to enter contracts in your jurisdiction to use Jokester.

If you're under 18, please don't use the platform — some of these jokes aren't for kids.

3. Your Account

In short: Your account, your responsibility.

  • Keep your login credentials secure — you're responsible for all activity under your account.
  • Don't share your login or let others stream under your account.
  • If you think someone's using your account without permission, contact us at info@jokester.live immediately.

4. Buying Tickets

In short: You buy it, you watch it.

  • When you buy a ticket, you're purchasing digital access to a comedy special or live event (not a physical product).
  • Unless otherwise noted, all sales are final.
  • If a show is canceled or technically fails on our end, we'll refund you or provide alternate access.
  • You'll receive a confirmation email after purchase, and your show will appear in your Order History.
  • Each ticket includes 7-day access from the time the show is made available.

5. Streaming & Access

In short: Watch anywhere, but it's for you — not the whole internet.

  • Your ticket grants personal, non-transferable access to stream the show through Jokester.
  • You may not copy, download, re-upload, broadcast, or share the content elsewhere.
  • We do our best to provide a smooth experience, but streaming quality can vary with your internet connection and device.
  • If something goes wrong, contact us — we'll make it right whenever reasonably possible.

6. Data Sharing with Comedians

In short: The comedian deserves to know who's in the crowd.

When you purchase a ticket, Jokester may share limited personal data (such as your name, email, and show-related details) with the comedian or their authorized representative.

This helps comedians understand their audience, deliver event updates, and connect with fans directly.

We only share what's necessary — never full payment info — and comedians must handle your data responsibly and in line with our Privacy Policy.

7. Comedians as Independent Contractors

In short: We host the stage, they own the mic.

Comedians performing on Jokester are independent contractors, not employees or agents of Jokester.

They control their own material and opinions — Jokester does not endorse or take responsibility for what they say or perform.

If you disagree with a joke, that's part of comedy. We're not liable for any offense or claims arising from a comedian's content.

8. Respect the Content

In short: Laugh, don't steal.

  • All shows and materials on Jokester are protected by copyright and other intellectual property laws.
  • You may not record, reproduce, or redistribute any Jokester content without explicit written permission.
  • Comedians retain ownership of their performances. Jokester retains ownership of its platform, design, and technology.

9. Community Standards

In short: Don't be a jerk.

We built Jokester for laughter, not chaos. That means:

  • No harassment, hate speech, illegal activity, or trolling.
  • We reserve the right to suspend or remove any user or content that violates these rules.
  • This applies to both fans and comedians. Comedy is free speech, but there's no place here for hate.

10. Refunds, Cancellations & Changes

In short: We'll be fair — both ways.

  • If a show is canceled or rescheduled, we'll notify you and issue a refund or alternate access.
  • Refunds aren't available for user error, slow Wi-Fi, or forgetting to watch within the access window.
  • If Jokester experiences a confirmed system failure, we'll make it right.

11. Disclaimer of Warranties

In short: We'll try our best — but we can't promise perfection.

Jokester is provided "as is" and "as available."

We don't guarantee uninterrupted or error-free service, or that every punchline will land.

To the extent permitted by law, we disclaim all warranties (express or implied), including fitness for a particular purpose or non-infringement.

12. Limitation of Liability

In short: We're here for laughs, not lawsuits.

  • Our total liability to you will never exceed the total amount you paid for the show or service in question.
  • We're not responsible for indirect damages like lost profits, emotional distress, or missed punchlines.
  • Some jurisdictions don't allow such limits — if that's you, your local laws apply.

13. Indemnification

If your use of Jokester violates these Terms or causes legal trouble, you agree to indemnify and hold harmless Jokester, its team, and partners from any resulting claims, damages, or costs.

14. Termination

We may suspend or terminate your account if you break the rules, misuse content, or act in bad faith. You can delete your account anytime by emailing info@jokester.live.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

Any legal action must be filed in the state or federal courts located in Delaware.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we'll post the new version here with a revised "Last Updated" date.

If the changes are significant, we'll notify you by email or through the site.

Continued use after updates means you agree to the new terms.
